New Video: 25 Years Of The Ginsburg Rule

Democrats have made clear that they will use Day 2 of Judge Kavanaugh’s confirmation hearing to force him to make clear how he would rule on issues like abortion, decisions like Roe v. Wade, and beyond. The video below is a reminder that for the past 25 years — from Ginsburg to Gorsuch, judges nominated by both Democrats and Republicans — SCOTUS nominees have held the position that it would be inappropriate to preview how they would rule on potential cases. In Justice Ginsburg’s words, the Ginsburg rule holds that, “A judge sworn to decide impartially can offer no forecasts, no hints, for that would show not only disregard for the specifics of the particular case, it would display disdain for the entire judicial process.”
